Project Summary:

The USAID/North Macedonia Partnership Against Corruption (PAC) activity intends to partner with the Government of North Macedonia to identify common priorities and co-create and co-invest in activities that strengthen national-level systems to reduce institutional vulnerabilities to corruption, and for the government and other anti-corruption entities to take action to address corruption when it occurs.As part of the USAID/PAC activity, we intend to support approaches to minimize abuse in the recruitment and management of public servants in North Macedonia.

Position Summary:

The Legal Expert will deliver technical support to the Ministry of Public Administration in drafting amendments to the Law on Administrative Servants (LAS) and the Law on Public Sector Employees (LPSE) of the Republic of North Macedonia. This activity is directed at minimizing abuse in the recruitment and management of administrative servants and public sector employees. For this engagement, the assignment period is expected to be from 1 November 2024 to 1 March 2025, with 40 days of effort required to perform the responsibilities and deliverables described below.

 

Responsibilities:

  • Develop a work plan, including a tentative timeline for task implementation during the engagement.
  • Perform a legal review of the existing LAS and LPSE, based on identified gaps in the implementations, comments from the consultation of the Ministry of Public Administration with various stakeholders, PAC's anti-corruption, and comparing the current version of the laws, its objectives, and its legal framework with best practices in other countries.
  • Identify gaps, ambiguities, and outdated provisions, analyze compatibility with the existing relevant legal framework.
  • Consult relevant authorities through participation in the meetings of the working group to understand the perspectives and challenges of the proposed laws.
  • Align proposed amendments with OECD/SIGMA requirements and good governance principles.
  • Perform a Regulatory Impact Assessment (RIA).
  • Evaluate economic, social, and environmental impact of the proposed laws.
  • Draft amendments to the two laws or new versions of the LAS and LPSE.
  • Provide a draft version of the sub-legislation within the recruitment and selection process including regulation of digital testing, temporary employment contracts, poor performance management disciplinary procedures, and career development, training, and personal development requirements.
  • Deliver a final report in English.

 

Qualifications:

  • Bachelor's degree with specialization in administrative law and public administration is required. Master's degree in administrative law or public administration is preferred.
  • Minimum 10 years of relevant experience in providing legal services is required.
  • Minimum five years of experience in the area of administrative law and public administration is preferred.
  • Experience in and familiarity in drafting laws related to North Macedonia is required.
  • Ability to conduct comparative legal analyses is required.
  • Strong analytical, communication, and presentation skills are required.
  • Fluency in English and Macedonian is required. Knowledge of Albanian is preferred.
